Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Optim Recruiting LLC ("OptimBusiness," "we," "us," or "our") concerning your access to and use of the optimbusiness.com website and any related services (collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Site and updating the "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.

Eligibility

You must be at least 18 years old to use the Site or subscribe to our services. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account and Subscriptions

Free Newsletter Subscription

Registration: You may subscribe to our free newsletter by providing your email address.

Content: Free subscribers receive curated insights delivered twice monthly via email.

Unsubscribing: You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us.

No Guarantee: We reserve the right to modify, suspend, or discontinue the free newsletter at any time without notice or liability.

Premium Subscription

Registration: Premium subscriptions require providing your name, email address, and payment information.

Access: Premium subscribers receive unlimited access to all published content, frameworks, research reports, and downloadable resources.

Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled before the renewal date.

Price Changes: We may change subscription prices with 30 days' notice. Price changes will not affect current subscription terms until renewal.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.

Refunds: We offer a 14-day money-back guarantee for new premium subscriptions. Refund requests made within 14 days of initial purchase will be honored, no questions asked. For annual subscriptions canceled after 14 days, we will refund the prorated amount for unused months. Monthly subscriptions are non-refundable after the 14-day window.

Payment Processing: Payments are processed securely through Stripe. You agree to provide accurate and complete payment information and to update it as necessary.

Failed Payments: If a payment fails, we will attempt to collect payment using your payment method on file. If payment cannot be collected within 7 days, your subscription may be suspended or canceled.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

  • Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from unauthorized use of your account.

Content and Intellectual Property

Our Content

All content on the Site, including but not limited to text, articles, graphics, logos, images, videos, software, and other materials (collectively, "Content"), is owned by OptimBusiness or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and view Content for personal, non-commercial use

  • Download articles and frameworks (premium subscribers only) for personal use

Restrictions: You may not:

  • Reproduce, distribute, or publicly display Content without permission

  • Modify, create derivative works, or reverse engineer Content

  • Remove copyright notices or attributions

  • Use Content for commercial purposes without a license

  • Republish Content on other websites or platforms

  • Use automated tools to scrape or download Content in bulk

Fair Use: Limited excerpts (50-100 words) may be quoted with proper attribution and a link back to the original article. Longer excerpts require written permission.

Your Content

If you submit comments, feedback, or other content to the Site ("User Content"), you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, and distribute your User Content for any purpose related to operating and promoting the Site.

You represent and warrant that:

  • Your User Content does not violate these Terms or applicable law

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, in our sole discretion.

You agree not to:

Harmful Activities

Indemnification

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.

Dispute Resolution

Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to contact us at hell@optimcareers.com to attempt informal resolution. We will work in good faith to resolve disputes amicably.

Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

You and OptimBusiness agree that any disputes arising from or relating to these Terms or the Site will be resolved through binding arbitration, rather than in court, except that:

  • You may bring claims in small claims court if they qualify

  • Either party may seek injunctive relief in court for intellectual property matters

Arbitration Procedures:

  • Arbitration will be conducted by the American Arbitration Association (AAA)

  • The arbitrator's decision is final and binding

  • The arbitrator may award damages and relief as a court could

  • Each party pays their own costs unless the arbitrator determines otherwise

Class Action Waiver: You and OptimBusiness agree that disputes will be resolved on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative actions.

Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to hello@optimcareers.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in court as described below.

Jurisdiction (If Arbitration Waived or Not Applicable)

If arbitration does not apply, you agree that any legal action will be brought exclusively in the state or federal courts located in Riverside, CA, and you consent to personal jurisdiction in those courts.

Termination

By You

You may terminate your account and subscription at any time by:

  • Canceling through your account settings

  • Contacting us at hello@optimcareers.com

  • Unsubscribing from the newsletter

By Us

We may suspend or terminate your access to the Site, with or without notice, if:

  • You violate these Terms

  • You engage in fraudulent or illegal activity

  • Your account has been inactive for an extended period

  • We discontinue the Site or service

Upon termination:

  • Your right to access the Site immediately ceases

  • Premium subscription access ends (subject to refund policy)

  • Provisions that should survive termination (e.g., disclaimers, limitations of liability, indemnification) remain in effect

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OptimBusiness regarding the Site and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

Notices to you may be sent via email to the address on file or by posting on the Site. Notices to us should be sent to hello@optimcareers.com.

Electronic Communications

By using the Site, you consent to receiving electronic communications from us. These communications are part of your relationship with us and satisfy any legal requirements for written notice.

Export Controls

You agree to comply with all applicable export and re-export control laws and regulations.
